What is a “convention against torture”?

A “convention against torture” is an international agreement that aims to protect people from any type of torture or cruel, inhuman, or degrading treatment. It was established in 1984 and has been ratified by most countries in the world, including California. The convention defines torture as any act that causes severe physical or mental pain and suffering, intentionally inflicted by government officials for the purpose of punishing or intimidating individuals. It also includes acts of deliberate physical or mental pain and suffering inflicted for the purpose of intimidating, coercing, or punishing a person or group for political, religious, or other reasons. The convention also forbids any forms of cruel, inhuman, or degrading treatment or punishment, even if it does not meet the definition of torture. This means that a government cannot resort to physical or mental pain or suffering as a form of punishment, even if it does not constitute torture. For example, the convention prohibits solitary confinement, public humiliation, and torture that does not result in permanent physical or mental harm. In addition, the convention establishes a right to asylum for victims of torture or cruel, inhuman, or degrading treatment. This means that people who are seeking protection from torture or other forms of abuse may be able to obtain asylum in California. To be eligible for asylum, applicants must prove that they are a victim of torture or mistreatment and that they have a well-founded fear of further such mistreatment in their home country.
