What is the “credible fear” standard?
The “credible fear” standard is a threshold that an immigrant must meet in order to be eligible for asylum in the United States under U.S. immigration law. In order to meet the credible fear standard, an immigrant must demonstrate that they have a “reasonable possibility” that they will be persecuted if they return to their home country. This can include a fear of physical harm, torture, or death, or a fear of persecution due to the immigrants’ race, religion, political opinion, nationality, or membership in a particular social group. This standard is used in Florida by immigration officials to decide whether an individual is eligible for asylum in the U.S. If the immigrant is able to demonstrate that they have a reasonable fear of persecution in their home country, they may be allowed to stay in the United States. If the individual is not able to demonstrate this fear of persecution, their request for asylum may be denied. The credible fear standard is an important part of U.S. immigration law, as it is used to protect individuals from oppressive and dangerous situations in their home countries.
