What are the “grounds for asylum”?
The “grounds for asylum” refer to the specific legal requirements that must be met in order for an individual to qualify for asylum in the U.S. In New Hampshire, an individual may be eligible for asylum if they have been persecuted, or fear persecution, on the basis of race, religion, nationality, particular social group, or political opinion. An individual who has been persecuted or who has a well-founded fear of persecution can demonstrate that they qualify for asylum protection by demonstrating to the U.S. government that they meet the definition of a “refugee” as defined by the laws of the United States. To be a refugee, an individual must have a well-founded fear of being persecuted in their home country based on their race, religion, nationality, particular social group, or political opinion. In addition, the persecution that an individual can fear must be either past persecution, or the applicant must be able to show a well-founded fear that they will be persecuted in the future if they return to their home country. This persecution must then rise to the level of being either “persecution on account of” their protected trait, or beyond what is reasonable to expect a person to endure. Finally, it is important to note that even if an individual has a well-founded fear of persecution, there are other legal requirements that must be met in order to qualify for asylum in the United States, such as admissibility, or the presence of an underlying legal issue.
