What happens if I am found to have a “credible fear”?

If you are found to have a “credible fear” of persecution or torture in your home country, then according to New Hampshire immigration law, you could be eligible for asylum. This means that you would be allowed to temporarily remain in the United States. The first step in the asylum process is to have an initial interview with an asylum officer. During this interview, the officer will determine if you have a “credible fear” of persecution or torture in your home country. If you are found to have a “credible fear”, you will be referred to an Immigration Court for a full hearing on your asylum claim. At the asylum hearing, the court will review your case and determine whether or not you meet the qualifications for asylum. This could include evidence of past persecution or a well-founded fear of future persecution due to your race, religion, nationality, political opinion, or membership in a particular social group. If the court finds that you meet the qualifications for asylum, then you will be granted asylum. This will allow you to temporarily remain in the United States and apply for a work permit. However, if the court decides that you do not meet the qualifications for asylum, then you may be ordered to leave the United States. In this case, you will need to return to your home country or seek another form of immigration relief.
