What is the “material support bar”?

The “material support bar” is a provision of the Immigration and Nationality Act (INA) that restricts certain individuals from seeking and receiving asylum in the United States. This bar applies to those who, within five years after the enactment of the provision, have given “material support” to any organization or entity that has been designated a foreign terrorist organization by the United States Department of State. In Delaware, if an individual can establish that the material support was given “under duress,” so that the individual had no meaningful choice but to give support, then they may still be able to receive asylum in the US. The law also states that any material support given willingly constitutes a “serious non-political crime” and would disqualify the individual from being able to seek asylum in the US. The definition of “material support” can be expansive, and can include money, goods or services, weapons, training, and the use of military equipment. There are also some types of support that are exempt from the bar, such as donations to purely humanitarian organizations. The material support bar is a complex law, and individuals should consult with an experienced immigration attorney to understand if they are affected by the bar. They may be able to successfully seek asylum in the US if they meet the exemption requirements or if they are able to demonstrate that they provided the support under duress. However, they should also be aware of the restrictions that the bar imposes and the ramifications for providing material support without meeting the required criteria.
