What is the “material support bar”?

The “material support bar” is an immigration law that bars certain people from applying for asylum in the United States. The bar applies to those who have provided material support to certain terrorist organizations, or whose actions have furthered the cause of terrorism or urged terrorist activities. The material support bar was enacted in 1996 as part of the Antiterrorism and Effective Death Penalty Act. Under the material support bar, people who have provided any kind of material support to a terrorist organization, even if it was done under force, coercion or threat, are ineligible for asylum defense in the United States. However, those seeking asylum can still apply for a waiver if they can prove that the material support was given under duress, that they did not have a reasonable ability to refuse the material support, and that the support was not to a terrorist organization. In Tennessee, the material support bar is applied to any individual who seeks asylum in the state. This means that if someone has provided any kind of support to a terrorist organization, they would not be eligible to apply for asylum in Tennessee and could be denied entry to the United States. However, if a person can prove that they were forced or coerced to provide material support, they may be able to be granted a waiver and be allowed to apply for asylum in Tennessee.
