What is the “material support bar”?

The “material support bar” is a policy in immigration law that was implemented by the U.S. government in 1996. It states that any person who has provided any kind of “material support” to a terrorist organization cannot be granted asylum in the United States. This includes both tangible and intangible support such as weapons, money, training, safe houses, and even advice or encouragement. In Vermont, this policy is enforced on all asylum seekers regardless of their country of origin or the circumstances of their situation. The “material support bar” has been criticized as unfair and overly strict, especially considering that the evidence is often circumstantial. Since it is difficult to prove definitively that one gave “material support” to a terrorist organization, many innocent people have been denied asylum under the policy. Furthermore, since people who are seeking asylum have often been persecuted in their home countries, it can be difficult for them to find legitimate evidence to support their case. Because of these issues, the U.S. government has recently relaxed the “material support bar” somewhat. But in Vermont, the policy remains in full force, and all applicants must prove that they did not provide any kind of “material support” in order to be granted asylum.
