How long do I have to remain in the U.S. after getting asylum?
After receiving asylum in the U.S., you have the right to remain in the country as long as you meet certain requirements. If you are granted asylum in the state of Illinois, or any other U.S. state, you can stay for as long as you meet the requirements given to you when you are granted asylum. According to the U.S. Citizenship and Immigration Services (USCIS), those with asylum status must file a Form I-485, “Application to Register Permanent Residence or Adjust Status,” within one year of being granted asylum and can stay in the U.S. as long as the application is pending. Furthermore, those with asylum are expected to maintain a valid form of identification from their country of origin and demonstrate that they are not a danger to the U.S. If the application is approved, then asylum recipients can stay in the U.S. as long as they continue to meet the requirements of their asylum status, which includes filing a Form I-90, “Application to Replace Permanent Resident Card,” every 10 years. However, if an asylum recipient has been in the U.S. for more than one year without having filed the Form I-90, their asylum status may be terminated. Overall, asylum recipients in Illinois have the right to remain in the U.S. for as long as they meet the requirements put forth by USCIS. This includes filing paperwork within one year of being granted asylum, as well as maintaining a valid form of identification and demonstrating that they are not a danger to the U.S.
