What is a “withholding of removal”?
A withholding of removal is a form of protection given by the U.S. government that prevents an individual from being removed or deported to a country where the individual’s life or freedom could be threatened. Under the Immigration and Nationality Act (INA), individuals are eligible for withholding of removal if they can demonstrate that their life or freedom would be threatened in their home country due to race, religion, nationality, membership in a particular social group, or political opinion. In North Dakota, individuals seeking protection under the U.S. government’s withholding of removal process are generally immigrants and noncitizens who are already in the United States and facing removal. After an individual has submitted their application for withholding of removal, it is reviewed by an immigration judge who will determine whether the individual has met the legal standards for protection. If an individual is granted withholding of removal, it is indefinite and does not lead to lawful permanent residence or citizenship. In most cases, an individual who is granted withholding of removal is also eligible for work authorization in the United States. Additionally, those granted this special protection are generally not subject to deportation, even if they are removed from the country for any reason. While withholding of removal does not provide a pathway to legal permanent residence or citizenship, it does provide an opportunity for individuals who face threat of persecution in their home countries to seek safety and security in the United States.
