What is an “asylum-based adjustment of status”?

An “asylum-based adjustment of status” is an application that someone can file to become a lawful permanent resident in the United States after they have already been granted asylum in Ohio. Individuals who have been granted asylum can apply to adjust their status to Lawful Permanent Resident (LPR) status, which would allow them to live and work legally in the United States. In order to be eligible for an adjustment of status in Ohio based on an asylum grant, the individual must meet certain requirements. These typically include having an approved asylum application, being physically present in the United States for the previous one-year period, being admissible to the United States, and not having engaged in certain activities that may render them inadmissible. The individual must also submit a Form I-485, Application to Register Permanent Residence or Adjust Status, to U.S. Citizenship and Immigration Services (USCIS). This application must include proof of identity documents, evidence of asylum status, and other evidence that may be required. After filing the form, the individual will be required to attend an interview with a USCIS officer. During this interview, the officer will assess the individual’s qualifications to adjust their status. Once approved, the individual will become a lawful permanent resident with all the rights and privileges that come with that status.
