What is an “asylum-based adjustment of status”?

An “asylum-based adjustment of status” is a process available to individuals who have been granted asylum in Washington. The adjustment of status is a way for these individuals to obtain a green card and become a legal permanent resident of the United States. To be eligible for an asylum-based adjustment of status, the asylum seeker must have been physically present in the United States for at least one year after being granted asylum. The asylum seeker must also have been granted asylum by the United States Citizenship and Immigration Services (USCIS). This means the individual must have obtained an affirmative grant of asylum by applying for asylum or through the “Deferred Action for Childhood Arrivals” (DACA) program. The individual must also have a valid passport and be admissible to the United States. Once all of these requirements have been met, the individual can submit an Application to Register Permanent Residence or Adjust Status (Form I-485) to USCIS to adjust their status. The application must be accompanied by the appropriate documentation and fees. Once the application has been approved, the individual will become a permanent resident and will receive a green card. This allows them to legally live and work in the United States and they will no longer need to renew their asylum status.
