What is “cancellation of removal”?
Cancellation of removal is a form of relief from removal (or deportation) under North Dakota’s immigration law. It is only available to certain non-citizens who have been placed in removal proceedings and can demonstrate that they have been living in the U.S. for a continuous period of at least 10 years. To qualify, an individual must also prove that their removal from the U.S. would cause exceptional and extremely unusual hardship to the individual themselves or to a qualifying family member. While cancellation of removal does not offer a path to lawful permanent residence, it does provide individuals who are already authorized to stay in the United States with the ability to remain here for the remainder of their natural life. This relief often translates into long-term security and stability for the family members involved. In addition to proving the 10 year continuous residence requirement, and exceptional and extreme hardship to the individual or their qualifying family members, an individual must also demonstrate that they have been of good moral character during the 10-year period and have not been convicted of certain offenses, such as a serious crime or a crime of moral turpitude. Cancellation of removal can be applied for as part of an asylum application, and is often sought in extreme cases, but it is not commonly granted.
