What is the “Protection Based on Family Reunification”?
Protection Based on Family Reunification is a part of the New York Immigration Law that allows immigrants who have experienced persecution, such as torture, to receive asylum and reunite with family members in the U.S. This protection is also available to immigrants who have not experienced persecution, but are related to someone who has. To be eligible for this protection, applicants must prove that they have a close family member in the U.S. who is either a U.S. citizen or a Permanent Resident (green card holder). The Family Reunification Program allows immigrants to stay in the U.S. for as long as they need. It also allows spouses, unmarried children under the age of 21, and parents to apply for asylum in the U.S. without having to leave the country. This is especially helpful for those who have experienced trauma and have no other way to enter the United States and reunite with their families. Furthermore, Protection Based on Family Reunification grants immigrants financial assistance and medical care so they can integrate into the U.S. society. Applicants have access to support from organizations such as Church World Service, American Red Cross, Lutheran Immigration and Refugee Services, and USCCB Migration and Refugee Services. The Protection Based on Family Reunification program has been immensely useful in providing those fleeing persecution with much needed support, and for reuniting families who have been separated due to traumatic events.
