What is the employer-sponsored immigration process?

Employer-sponsored immigration is when employers sponsor a foreign worker for an immigrant or nonimmigrant visa in order to have them fill a particular job. Generally speaking, this process requires employers to obtain a labor certification from the United States Department of Labor, followed by filing a petition with the United States Citizenship and Immigration Services (USCIS). The labor certification process requires employers to establish that there are no qualified U.S. workers available for the position they are trying to fill with the sponsored employee. This involves conducting a recruitment effort, filing a labor certification application, and gathering other evidence (such as wages they are offering) to prove the qualifications of the sponsored employee. After the labor certification is approved, employers must file a Form I-140, Petition for Alien Worker, with the USCIS. The Form I-140 contains evidence of the labor certification as well as the sponsored worker’s qualifications. Once the Form I-140 is approved, the sponsored employee can then apply for their visa. Depending on the type of visa, the employee may need to complete additional steps. For example, for an immigrant visa, the employee would need to apply for an Immigrant Visa interview at the United States embassy. The employer-sponsored immigration process is highly complex and involves a great deal of paperwork.
