What is the L-1A visa and who is eligible for it?

The L-1A visa is a visa that allows a company headquartered outside of the United States to transfer certain managerial or executive personnel to the United States in order to oversee the operation of a branch, subsidiary, or affiliate of the foreign company in the U.S. This visa provides foreign companies with the ability to transfer experienced personnel from one of their foreign locations to the United States in order to facilitate the establishment of the U.S. business’s operations. This type of visa is available to employees of the foreign company who have worked for the company for at least one year out of the three years prior to entering the U.S. Furthermore, those that are eligible for this visa must be coming to the United States to be employed in a managerial or executive capacity. This would include those who can manage the entire organization or a major department or function within the organization. It is also important to note that the applicant must show that they possess specialized knowledge of the company by either having expertise in the company’s products, services, research, equipment, techniques, management, or other similar areas. In Pennsylvania, those who have been approved for an L-1A visa may stay in the United States for up to seven years. Furthermore, it is important to note that those who have been approved for an L-1A visa may also be able to apply for a green card. This process, however, will involve additional paperwork and fees.
