What is the process for renewing non-immigrant status?

In Indiana, non-immigrant status is typically renewed by filing Form I-539. This form must be filed within 6 months of the expiration date of the individual’s current non-immigrant status. Applicants must include a copy of their valid passport, a copy of their exit and entry documents, the application fee, and any other specific documents requested for the Form I-539. If the applicant is an employer, they must also include proof of their intent to employ the individual. Once the completed application is submitted to the US Citizenship and Immigration Services (USCIS), the individual will receive a notice of receipt and will be required to attend an interview at the local USCIS office. During the interview, the applicant will have to demonstrate their intentions are still valid as when they were granted the non-immigrant status. If the immigration officer determines the application is complete and all the requirements are met, the individual’s non-immigrant status will be renewed. If the application is denied, the applicant will receive a notice of denial and a chance to appeal the decision if they wish. If the individual does not take action to appeal within the timeframe specified in the notice of denial, they will be at risk of being removed from the US. Therefore, it is important to ensure all necessary steps are taken when applying for renewal of non-immigrant status and to follow all instructions carefully.
