How long do I need to employ an immigrant worker?
In Washington, the amount of time an employer must retain an immigrant worker is typically dependent upon the type of visa that the worker is employed under. For instance, if the worker has an H-1B visa, an employer must retain them for the length of the visa, which is typically three years. Alternatively, if the worker has an L-1 visa, an employer must retain them for the length of the visa, which is typically five or seven years. Lastly, if the worker has an E-1 or E-2 visa, an employer must retain the worker indefinitely until employment is terminated. It is important to note that not all immigrant workers are employed under one of these visas. Therefore, employers of immigrant workers that do not have a visa must adhere to the laws of the state and the employer’s internal policies. Laws may vary from state to state, however, employers are responsible for ensuring that they are compliant with any applicable laws and policies regarding the length of time for which they employ an immigrant worker.
