What is the process for adjusting status?
The process for adjusting status in Florida involves filing Form I-485, the Application to Register Permanent Residence or Adjust Status. First, the applicant must demonstrate eligibility for Adjustment of Status. This includes having been inspected and admitted or paroled into the United States, having a current visa, being in the United States as a nonimmigrant, and other requirements. The applicant must include other forms with the I-485, such as Form I-765 to apply for a work permit, Form I-131 for travel permission, and Form I-864, Affidavit of Support. They must also include evidence of their eligibility for adjustment of status, such as a valid passport, proof of lawful status, proof of financial support, and more. The applicant must also submit the application with the current filing fee and biometrics fee. Once the forms and evidence are received, USCIS will review the materials and if approved, the individual must attend an interview with an immigration officer. If all is in order, and if the applicant is granted the adjustment of status, he or she will be issued an Employment Authorization Document and will be eligible to apply for lawful permanent residence.
