What is the process for adjusting status?

In Indiana, the process for adjusting status is broken down into steps. Adjustment of status allows someone who is not a US citizen to become one. The first step is to determine if you are eligible to apply. To be eligible you must have been inspected and admitted or paroled into the United States, have an approvable immigrant petition, have an immigrant visa number available, and not be ineligible for an immigrant visa. The next step is for the applicant to complete and submit the Form I-485 (Application to Register Permanent Residence or Adjust Status). This form must be completed accurately and completely and must be accompanied by supporting documents including proof of the applicant’s identity, immigration status and eligibility for the immigrant visa. Once the Form I-485 is submitted, the applicant will be required to attend an interview at a local immigration office. During the interview, the applicant may be questioned with regards to their identity, immigration status and eligibility for the immigrant visa. After the interview, a decision will be made as to whether or not the applicant’s status will be adjusted. Finally, if the decision is favorable, the applicant will be required to complete the remaining steps in the process including completing the requirements to obtain a green card and making any necessary payments. Once these steps have been completed, the applicant’s status will have officially been adjusted and they can now begin their journey to becoming a US citizen.
