What is the process for removing conditions on permanent residency?
Removing conditions on permanent residency is a process that involves several steps. In the state of Florida, the process begins with filing Form I-751: Petition to Remove Conditions on Residence. This form can be submitted either jointly with a U.S. citizen or legal permanent residence spouse or as a waiver if the citizen or permanent resident spouse has died, divorced, or can’t be found. In order to file Form I-751, the applicant must provide documentation along with the form such as evidence of the relationship with the US citizen or permanent resident spouse, evidence of a valid marriage, and evidence of good faith marriage. After submission of the form, the USCIS will send a receipt notice with a notice for an interview. The interview is meant to confirm that the marriage is not fraudulent and that the relationship is legitimate. The applicant must attend the interview with the US citizen/permanent resident spouse or with an attorney if needed. The USCIS officer will then notify the applicant of their decision and if approved for removal of conditions the permanent residence status will be extended for a full 10 years with the same rights as any other permanent resident.
