Yes, there are special considerations for a child to apply for an immigrant visa as an orphan. In Illinois, an orphan is defined as a child under the age of 18 without any living parents or legal guardians. The process is slightly different for an orphan immigrating from abroad than for an orphan within the U.S. For a child abroad, the U.S. Citizenship and Immigration Services (USCIS) must approve a Form I-600, Petition to Classify an Orphan as an Immediate Relative. The child must also meet the definition of an orphan according to the definition on the form, and have a valid passport from their native country. In order for the petition to be approved, the USCIS may require additional documents such as evidence of the death or abandonment of the parents and adoption or other court documents. For an orphan already within the United States, special protections are available. The Department of Homeland Security can grant a green card to an orphan under the age of 16 if the child is lawfully present in the U.S., has been declared an orphan by a state court, and the USCIS has deemed he or she eligible for a green card through adoption. Regardless of where the child is immigrating from, an orphan will need to have a medical examination prior to admission to the U.S. Additionally, the child may need to have a custodian or guardian appointed in the U.S. before they can be admitted. Finally, the child will need to be admitted by an immigration officer at a U.S. port-of-entry.
