What is voluntary departure?
Voluntary departure is an action taken by the U.S. Department of Homeland Security or an Immigration Judge to allow a foreign national to leave the United States without being formally deported. When a foreign national is granted voluntary departure, they are given a specific amount of time to leave the country. This is usually anywhere from 30 to 120 days. In Arizona, a foreign national can be given voluntary departure if they have been accused of violating U.S. immigration law. U.S. Immigration and Customs Enforcement (ICE) can offer voluntary departure to certain individuals who comply with certain criteria. These criteria usually include having no criminal history, being present in the United States for a certain number of years, and being of good moral character. If ICE approves voluntary departure, then the foreign national will be required to leave the country by a certain date with their own funds. Voluntary departure is beneficial because it allows a foreign national to leave the United States without having a formal deportation on their record. This can make it easier for them to return to the United States in the future as they will not have a formal deportation mark on their record. It also saves the government the time and money it takes to formally deport someone.
