What is voluntary departure?
Voluntary departure in Utah immigration law is an alternative to deportation in certain situations. It typically allows an individual to avoid federal penalties associated with deportation and leave the country in a manner that avoids most of the harsh consequences of being formally deported. Under voluntary departure, an individual agrees to leave the country before a court order of deportation is issued. The individual typically has to pay their own way to depart and usually must do so within a limited period of time, typically 30-60 days. In exchange for agreeing to leave willingly, the individual may avoid most of the consequences and penalties of deportation. Voluntary departure is discretionary, meaning that the court may choose to grant or deny the request. Individuals who are granted voluntary departure will typically still have to submit to certain conditions like passing a background check and forfeiting their U.S. visa or green card. In some cases, an individual may be granted voluntary departure in order to avoid the negative consequences of deportation, such as limited eligibility for future immigration opportunities or a decrease in the chance of future successful admissions. However, individuals granted voluntary departure are generally unable to return to the U.S. without special permission until a set period of time has passed.
