What is mandatory departure?

Mandatory departure is a form of deportation in New York that requires someone who is not a permanent resident of the United States to leave the country. This is usually a result of someone overstaying their visa, entering the country illegally, or committing a crime in the United States or another country. In New York, anyone who is subject to mandatory departure must leave the country. Once someone has been identified as being subject to mandatory departure, they must be given the opportunity to seek immigration-based relief from this potential removal. Mandatory departure is one of the most punitive forms of immigration enforcement, however it is necessary to ensure individuals comply with the laws in place that protect the nation from unlawful entry.
