What is a Motion to Reopen or Reconsider?
A Motion to Reopen or Reconsider (MTR) is a request filed with the Executive Office for Immigration Review (EOIR) in Arizona to review a prior decision made in a case that has already been closed. This can be done by a party that is either in the United States or outside of the country, although most motions are filed from inside the United States. A MTR in Arizona can be filed for any type of immigration case, including applications for adjustment of status, asylum applications, and deportation proceedings. The purpose of an MTR is to ask for a new decision in a prior case. For example, if a person was previously denied asylum in the United States, they can file a Motion to Reopen to ask the immigration court to reconsider their application based on new evidence or changed circumstances.
