What is a Temporary Protected Status (TPS)?

Temporary Protected Status (TPS) is a form of immigration relief provided by the Department of Homeland Security (DHS) to immigrants in the United States from certain countries. The TPS designation is given to immigrants from countries that the US considers to be unsafe and puts them at risk. To qualify for TPS, an individual must be a national of a designated country and have been already living in the US at the time of the designation. TPS allows qualified individuals to remain in the US and prohibits their deportation, and they are eligible to receive an Employment Authorization Document (EAD). The EAD allows them to work legally in the US and to obtain a Social Security number. In Texas, individuals who have been granted TPS are generally eligible to receive relief from deportation. However, TPS does not offer a path to permanent residency or US citizenship. It does not give them a lawful immigration status permanently, but only temporarily. Depending on the country, TPS can last up to 18 months and can be renewed if conditions in the designated country have not improved. TPS is also subject to termination by the DHS if the circumstances that led to its designation change.
