What is an Application for Cancellation of Removal?
An Application for Cancellation of Removal is a form used to apply for relief from removal, or deportation, from the United States. This form is available to certain non-citizens who have been living in New York for at least 10 years and who meet other specific criteria. To be eligible for this form of relief, the non-citizen must demonstrate that they have been present in the United States for a continuous period of at least 10 years. The person must also prove that deportation would cause exceptional and extremely unusual hardship to their U.S. citizen or lawfully permanent resident relative(s). Additionally, they must not have been convicted of certain criminal offenses listed in the Immigration and Nationality Act. The Application for Cancellation of Removal requires individuals to provide evidence of 10 years of continuous U.S. residence and hardship, as well as a statement about why they should not be removed. The form must be filed with U.S. Citizenship and Immigration Services or, for certain non-citizens in removal proceedings, with the Immigration Court. If approved, the individual receives lawful permanent resident status and can remain in the United States until the cancellation of removal is no longer effective.
