What is a Voluntary Departure?
A voluntary departure is a type of immigration enforcement measure available to an individual facing deportation from the United States. It is offered as an alternative to the full legal process of removal from the country. In a voluntary departure, the foreign national can choose to leave the United States without an order of removal from an immigration court. Under North Dakota immigration law, voluntary departure is approved on a case-by-case basis and can be granted before or after an individual has received a final removal order from the immigration court. An individual must meet certain requirements to be eligible for voluntary departure, such as having a valid passport and having the financial means to pay for their own travel expenses. In voluntary departure, the individual is required to leave the United States within a specified amount of time, usually between 30 and 60 days. If they fail to do so, they may be subject to a fine, re-detention, or an Order of Removal from an immigration judge. Additionally, if an individual has received a final removal order, they will not be eligible for voluntary departure. Voluntary departure is a beneficial option for individuals facing removal from the United States because it allows them to maintain some of their rights as a foreign national.
