What is a Reentry Permit?

A reentry permit is a document issued by the U.S. Citizenship and Immigration Services (USCIS) that allows legal, non-citizens to return to the U.S. after they have spent a prolonged period of time abroad. This document is also sometimes referred to as a reentry visa. Generally, non-citizens who are seeking to remain in the U.S. on a lawful basis are the ones who apply for reentry permits. In Colorado, individuals who are subject to deportation may also apply for a reentry permit to the USCIS. A deportation order can be issued by the court, or may be issued by the USCIS after they determine that the individual in question is no longer eligible for their lawful status in the U.S. A reentry permit gives a person the ability to temporarily leave and then return to the U.S. in order to attend legal proceedings. This can be important if an individual is fighting to remain in the U.S. in spite of the deportation order. However, it is important to keep in mind that a reentry permit does not make an individual immune from deportation. If an individual leaves the U.S. and then returns while the deportation order is still in effect, they may still be subject to removal from the U.S. A reentry permit may simply give an individual more time to put together a legal defense against their deportation.
