What is a Notice to Appear?
A Notice to Appear (NTA) is a document that the U.S. Immigration and Customs Enforcement (ICE) will issue to a non-citizen in Arizona to inform them of their initial court hearing. It is a formal statement of the government’s intention to initiate deportation proceedings against a foreign national who is unlawfully present in the United States. The Notice to Appear will contain the name of the person being targeted for removal, their date of birth, and a description of the grounds for deportation. It will also include the date and time of their first court hearing. A person served with an NTA should not ignore it, as this will likely result in an order of removal by the immigration judge. The Notice to Appear must be served in person. It is normally served on the person who is the target of the action, but may be served on a family member, friend, or other representative. The Notice to Appear must include a warning if the individual does not appear to their court hearings, an order for removal from the United States will likely be entered against them. The NTA may also provide other information such as the availability of legal assistance. In Arizona, a person who has received a Notice to Appear should seek legal counsel to help understand their options and how to properly respond. An immigration law attorney with experience in deportation cases can provide guidance on how to proceed, as well as help represent them in court.
