What is a Final Order of Removal?

A Final Order of Removal (also known as a deportation order) is a decision made by an immigration court or the Board of Immigration Appeals that an individual must be removed or deported from the United States. The order is issued after an individual has been found to have violated U.S. immigration laws. In Oregon, a Final Order of Removal is issued to individuals who have entered the country without authorization, violated the terms of their visa or visa waiver, or been convicted of a crime that qualifies as an aggravated felony or an offense involving moral turpitude. A Final Order of Removal is considered a final decision and is enforced by Immigration and Customs Enforcement (ICE). The individual who has received the order is immediately subject to detention or deportation proceedings. In some cases, ICE may appeal the decision or allow the individual to remain in the United States, depending on the circumstances. The individual issued the order can generally request a stay of the order while they pursue other options, such as an appeal of the decision or the filing of an asylum application. If the Final Order of Removal is not appealed or the appeal is denied, the ICE will begin to make arrangements for the deportation of the individual. In Oregon, individuals facing a Final Order of Removal can seek services from organizations such as the Immigrant Law Group, which provides free legal assistance to immigrants facing deportation.
