What is a stay of removal?
A stay of removal is an action taken by the court that stops a person from being deported from the United States. It is a temporary reprieve from deportation and does not guarantee that an individual will be allowed to stay in the country indefinitely. In Wisconsin, a stay of removal may be granted to individuals facing deportation proceedings for various reasons. When a stay of removal is granted, it means that the court has temporarily blocked the deportation of the individual and is allowing them to remain in the United States. In some cases, individuals granted a stay of removal may be able to obtain work permits and re-enter the country in the future. However, the individual must still comply with all rules and regulations set out by the court in order to remain in the United States. The decision to grant a stay of removal is not taken lightly by the court and is based on the merits of the individual’s case. Factors the court considers include: the hardship the removal would create for the individual, family, or community; the likelihood of the individual re-entering the country in the future; the individual’s work history and record; and the overall impact of the deportation. Ultimately, the court will render a decision about whether or not to grant a stay of removal. In some cases, the stay may be granted for a limited period of time, while in other cases it may remain in place for the full duration of the deportation proceedings.
