What is a Notice of Intent to Deny?

A Notice of Intent to Deny (NOID) is an official form issued by the Department of Homeland Security (DHS) when it intends to deny an application for immigration-related benefits. In New Mexico, NOIDs are issued when the DHS does not believe the individual meets certain legal requirements to be eligible for the benefit they are seeking. When a Notice of Intent to Deny is issued, the individual will have the opportunity to provide additional information to support their case. This information must be provided to DHS within 30 days of the NOID. Once the information is received, DHS will review it and may either change their decision and grant the benefit or deny the application. It is important to note that receiving a NOID does not necessarily mean that the individual will be deported. It is possible that, if the individual provides the appropriate information and meets the eligibility requirements, DHS may still grant the immigration-related benefit. Additionally, if an individual receives a NOID and does not respond in the allowed timeframe, their case will be referred to the Immigration Court for review. In New Mexico, it is important for any individual who receives a Notice of Intent to Deny to consult an immigration lawyer to understand their legal rights and determine the best course of action. This will help them to ensure that their rights are being adequately protected and that they have the best possible chance of avoiding deportation.
