What is a Notice of Intent to Deny?

A Notice of Intent to Deny (NOID) is a document issued to individuals by the North Carolina immigration court when the court has determined the individual is inadmissible to the United States and therefore ineligible for lawful permanent residence. This document explains the reasons why the individual is being denied the right to stay in the United States and informs the individual of their rights to appeal the decision. NOIDs can be issued for several reasons, including but not limited to, failing to meet the requirements of a visa, discrepancies between their submitted paperwork and the corroborating evidence, criminal convictions or suspected criminal activity, health risks to the public, and prior deportations or removals from the United States. When an individual has received a NOID, they have the right to appeal the decision within 30 days, and must do so through a combination of legal documents, evidence, and any other relevant documents that support their case. Any applicable immigration attorneys must also be included as part of the appeal. Once the appeal is submitted, the individual will receive a final decision from the court in the form of an order. It is important to remember that an NOID can be issued before the individual is removed from the United States, and in some cases, may be used to negotiate with the court or immigration officials. Therefore, it is important to understand the implications of the NOID, and seek the help of a qualified immigration attorney if you or someone you know has received an NOID.
