What is a Notice of Intent to Deny?

A Notice of Intent to Deny is a document issued by the Texas Department of Public Safety informing someone who applied for a form of immigration relief that they may soon be deported from the United States. The Notice of Intent to Deny generally informs the applicant that their request has been denied and that the Department of Public Safety is recommending deportation from the United States. A Notice of Intent to Deny will be issued to individuals when the Department of Public Safety believes that the applicant may not be eligible for immigration relief in the United States and may be deported. The Notice of Intent to Deny will explain why the Department of Public Safety believes that the applicant should be deported, and will also provide information on which agency the applicant can contact to learn more about their immigration status and options. The Notice of Intent to Deny can also give the applicant the opportunity to present any additional evidence they may have that could help to prove their case. This additional evidence may include documents such as medical records, educational records, and other evidence that may show why the individual should not be deported. The Notice of Intent to Deny provides a way for the Department of Public Safety to inform individuals of their potential for deportation and to provide them with an opportunity to contest the decision. If the individual is unable to provide additional evidence to support their case, then the Department of Public Safety may move forward with their recommendation of deportation and the individual may be removed from the United States.
