What is a Stay of Removal?

A Stay of Removal is a request made to the Department of Homeland Security to stop an individual from being deported from the United States. It is a way to challenge an order of deportation and to delay any removal action from being taken against a person. In the state of New Hampshire, people can make a Stay of Removal request if they have been issued an order of removal from the U.S. and are facing imminent deportation. The request for a Stay of Removal should be made to an immigration judge and can be filed with either the Court of Immigration Appeals or the Board of Immigration Appeals, depending on the individual’s case. The judge will review the Stay of Removal request and decide whether to grant the stay for a specified period of time. If the stay is approved, the individual will remain in the United States during the period of the stay. In some cases, the Stay of Removal can be extended for a longer period of time, depending on the individual’s case. This could be considered if the individual’s immigration case has not yet been resolved or if the individual has been granted relief from deportation. In any case, a Stay of Removal should not be seen as a way to permanently escape deportation but simply as a way to delay it and to explore other options.
