What is a Motion to Dismiss?

A Motion to Dismiss is a legal document that is filed with a court in attempt to end a case. In deportation cases, a Motion to Dismiss is used to ask the court to stop a person’s deportation proceedings before they’re even started. In Tennessee, a Motion to Dismiss can be filed in immigration court if an individual has a valid legal argument as to why their case should be either completely dismissed (all charges dismissed) or partially dismissed (some charges dismissed). This is done to protect the individual’s rights, as well as to limit the amount of time they are in the deportation proceedings. To be successful, a Motion to Dismiss needs to be based on the facts and evidence presented in the case. If the case doesn’t contain enough information to support a Motion to Dismiss, then the court will not grant it. In Tennessee, some valid reasons for filing a Motion to Dismiss could be lack of knowledge of the case, lack of jurisdiction (if the case is not in the correct court), or lack of evidence. If the court grants a Motion to Dismiss, the deportation proceedings are stopped and the individual is no longer under threat of deportation.
