What is the difference between an immigration judge and an immigration officer?
An immigration judge and an immigration officer are two very different roles in the immigration law system. A judge is responsible for overseeing the judicial process of a deportation hearing. An immigration judge is responsible for deciding whether a person should be removed from the country due to their status or actions, which includes determining an individual’s eligibility for relief from removal. During a hearing, the judge may examine evidence that is presented, cross-examine the parties, and make a decision about the individual’s status. In Alaska, immigration judges are employed by the U.S. Department of Justice, and operate under the Office of Immigration Review. An immigration officer, on the other hand, is responsible for enforcing the law. Immigration officers are employed by the U.S. Department of Homeland Security, and work in enforcement programs within U.S. Customs and Border Protection and Immigration and Customs Enforcement. Overall, immigration judges and officers both work to ensure the safety and security of the country. While a judge is responsible for deciding if an individual should be removed from the country, an officer is responsible for enforcing immigration laws and policies.
