What is the difference between an immigration judge and an immigration officer?
An immigration judge and an immigration officer are two different roles within the realm of immigration law in Colorado. Immigration judges are full-time employees of the U.S. Immigration Court, which is part of the Department of Justice (DOJ). They are responsible for hearing cases in which immigrants are facing a deportation order. Immigration judges decide whether non-citizens should be allowed to remain in the United States or be deported, and if so, under what conditions. Immigration officers, on the other hand, are part of the U.S. Department of Homeland Security (DHS) and are mainly responsible for enforcing immigration laws, such as making sure non-citizens are in the U.S. legally and for investigating and taking action on immigration violations. They have the power to issue immigration detainers and arrest warrants to immigrants, as well as conduct interrogations and searches. Immigration officers are also responsible for carrying out deportation orders if the immigration judge has issued one. So, the immigration judge and the immigration officer have two different roles in the enforcement of immigration laws in Colorado. The immigration judge determines whether a non-citizen should be allowed to stay in the U.S. while the immigration officer is in charge of enforcing the decision of the immigration judge.
