What is the Immigration Reform and Control Act?
The Immigration Reform and Control Act (IRCA) is a federal law passed in 1986 that aimed to reduce the number of undocumented immigrants in the United States. The act made it illegal for employers to knowingly hire undocumented workers and instituted penalties for employers who failed to comply. It also created a legal pathway for some undocumented immigrants to gain legal status and eventual citizenship. In Pennsylvania, the act requires employers to verify the legal status of any applicants during the hiring process. This includes asking applicants to verify their citizenship or residency in the United States by presenting documents such as a valid driver’s license, passport, or Social Security card. Employers in Pennsylvania also have to fill out forms to be submitted to the U.S. Citizenship and Immigration Services which verifies the worker’s eligibility for employment. The IRCA also established the Immigration and Naturalization Service, which is responsible for matters involving deportation, naturalization, processing of refugees, and other matters related to immigration.
