What is the “one-year bar”?
The “one-year bar” is a rule that applies to those who have attempted to enter the United States without proper documentation or authorization. In California, if an individual is deported from the U.S., they may be unable to return for up to a year. This is referred to as the “one-year bar” and it applies to all those who have been deported from the U.S. within the last year. The one-year bar is part of the Immigration and Nationality Act and is designed to discourage illegal immigration. In addition, it also gives the U.S. time to investigate immigration cases and evaluate the individual’s qualifications for entry. Those who are not permanent residents of the U.S. are especially vulnerable to the one-year bar, since they are more likely to have entered the country without proper documentation. Such individuals usually face a much longer wait before they can apply for a visa or other type of authorization to reenter the U.S. Individuals who are deported are typically ineligible to return to the U.S. for at least one year. This means that during this time, they are unable to visit family, reunite with loved ones, or work in the U.S. In many cases, it can also have a lasting impact on their ability to obtain legal status or other forms of authorization to stay in the U.S. indefinitely.
