What is the “one-year bar”?

The “one-year bar” is a provision within immigration law that prevents certain foreign nationals from returning to the United States within one year from the date that they depart. This includes any foreign nationals that have voluntarily left the country after living in the United States for more than one year and those who have been ordered removed, deported, or excluded from the country. In New Hampshire, any foreign nationals that are found to be out of status in the U.S. or who have been otherwise ordered removed, deported, or excluded by an immigration judge, have to wait one year before they can apply to be readmitted, unless they can demonstrate exceptional hardship to a U.S. citizen or lawful permanent resident. The one-year bar is meant to discourage people from attempting to enter the United States without proper documentation or authorization. The one-year bar is not a lifetime ban and the one-year period may be waived or shortened in certain cases. For example, if the applicant can demonstrate that his or her presence in the U.S. is in the country’s best interest, or that the individual will suffer undue hardship if the one-year bar is enforced, these circumstances may be grounds for a waiver or reduction of the one-year bar. The foreign national must show that the waiver or reduction of the one-year bar is necessary, fair, and meets the conditions of the immigration law.
