What is the “one-year bar”?

The “one-year bar” is an immigration law in the state of New Mexico which states that a person who has been previously deported from the United States is not eligible to apply for readmission or other relief from deportation for at least one year from the time they were deported. This “one-year bar” applies to individuals who have been deported for any reason, regardless of how long they have resided in the U.S. This law is designed to discourage people from re-entering the United States without proper authorization. Individuals hoping to return to the United States must wait 12 months before they can apply for readmission or other relief from deportation. This law is based on a belief that people who have been deported should not be able to easily return to the United States if they have already violated immigration laws in the past. The one-year bar applies to all deported individuals in New Mexico, regardless of their prior length of residence in the U.S., meaning that individuals who have been living and working in the U.S. for years could still be subject to this law if they are deported.
