What is the “one-year bar”?

The “one-year bar” is a law related to deportation that is specific to South Carolina. This law states that any immigrant who has been convicted of a crime that is considered deportable by US Citizenship and Immigration Services (USCIS) must wait for one year from the date of their conviction before they can seek an adjustment of their status or any other form of immigration relief from deportation. This law applies to both permanent and non-permanent residents of South Carolina. The one-year bar serves as a form of deterrence as it prevents immigrants from seeking relief from deportation until a year has passed. This serves to discourage immigrants from engaging in criminal activity, as they would otherwise be unable to ask for immigration relief until at least a year later. This policy also gives USCIS a chance to evaluate the situation and decide whether someone is qualified for relief and if so, what kind of relief they should receive. It is important to note that this law does not apply to immigration proceedings that are already being conducted. It is meant to apply to those immigrants who are already facing deportation proceedings, and it is not meant to be used to deny someone the ability to apply for relief. In order to avoid being subject to the one-year bar, immigrants should always ensure that they are complying with all immigration laws and only engaging in lawful activities while residing in the United States.
