What is “ re-entry after deportation”?
Re-entry after deportation is the act of a person returning to the United States after having been formally removed or deported from the country. Deportation is the term used when a foreign national is forcibly removed from the U.S. due to illegal activity, judgement by an immigration judge, or due to not having entered the country legally. Once a person is deported from the U.S., they are not allowed to return to the country until they have received permission from a U.S. immigration officer. In New Mexico, anyone who wishes to re-enter the U.S. after being deported must obtain an immigrant visa from the U.S. Embassy or Consulate in the country they are from and present it to the U.S. Customs and Border Protection officers at a port of entry. Generally, anyone who has been deported cannot return to the U.S. for up to 10 years. This time period can be extended if they are deemed inadmissible for a certain amount of time. Those who wish to re-enter the U.S. may also apply for a waiver of inadmissibility. This can be a complex process and is not guaranteed approval. Approval of a waiver depends on the individual’s case, and the circumstances of their deportation and re-entry.
