How can I apply for a Stay of Deportation?

In order to apply for a Stay of Deportation in Alaska, you must first file a Form I-246 (Application for a Stay of Deportation or Removal) with the U.S. Immigration and Customs Enforcement (ICE) office located in your area. The form is available online from the official ICE website and can be completed and submitted to the local office. In order to be approved for a Stay of Deportation, you must provide evidence to demonstrate that you do indeed have a valid reason to stay in the U.S. This could include evidence of family ties, financial obligations, or other factors that demonstrate that your removal from the United States would cause an undue hardship. You can also submit evidence of hardship that would result from being separated from an immediate family member who is a U.S. citizen or lawful permanent resident. In addition to filing the Form I-246, you may also need to submit additional documentation that supports your application. This could include evidence of employment status, evidence of family ties, or evidence of any other factors that demonstrate that you should be allowed to remain in the U.S. Once you have submitted the Form I-246 and supporting documentation, you may be asked to appear in person at one of the ICE locations in Alaska in order to complete the interview process. At this interview, you will be asked questions about your reasons for wanting to stay and will be asked to submit additional evidence that demonstrates your ties to the United States. If the interview is successful and the evidence submitted is convincing, ICE may grant you a Stay of Deportation.
