What is a Notice of Action (NOA)?

A Notice of Action (NOA) is an official letter from the Immigration and Naturalization Service (INS) or the Department of Homeland Security (DHS) alerting noncitizens about the status of their immigration proceedings. An NOA is part of the deportation process and is sent to noncitizens who have been charged with deportability, are subject to a final order of deportation, or who are appealing a denial of an immigration application. An NOA will generally include the decision of the INS or DHS, the reason it was made, and the legal consequences of the decision in detail. It will also provide instructions on what the recipient must do in order to have their case heard in court or with an immigration judge. The NOA will also include the date and time of the hearing, the location of the hearing, and any other relevant information about the proceedings. If the NOA is for an appeal, it will explain the reasons why the appeal was denied and the option to request a reconsideration or a further review of the decision. It is important for noncitizens to read the NOA carefully and to contact an immigration attorney or advocate for assistance understanding the NOA and the consequences of the decision.
