What is an immigration detainer?
An immigration detainer is a request from Immigration and Customs Enforcement (ICE) to a law enforcement agency, asking that agency to hold an individual for up to 48 hours after they would have been released from that agency’s custody. In cases of deportation, an immigration detainer requires that law enforcement hold a person until they can be turned over to ICE, who will then begin the process of deportation. In North Carolina, ICE detainers are issued when an individual does not have the required documents to verify their legal status in the United States. When a detainer is issued, the individual will not be released from custody until the ICE detainer is cleared. This means that the person must present valid immigration documents. If the detainer cannot be cleared, the individual may be put into removal proceedings. In some cases, a person may be able to fight an immigration detainer and avoid deportation. For instance, a court may order that an individual is released from custody or that an immigration detainer is not valid. However, it is important to note that immigration detainers in North Carolina are serious and can result in deportation.
