What is an immigration detainer?
An immigration detainer is a document issued by the U.S. Immigration and Customs Enforcement (ICE) to local law enforcement in North Dakota. It informs the local law enforcement that a non-citizen is in their custody and that ICE intends to take the person into federal custody for possible deportation. The detainer requests that the local law enforcement detain the person beyond the regular release date so that ICE can take the person into custody. The detainer does not guarantee deportation—it merely allows ICE to take the person into custody and decide whether or not to pursue deportation. Immigration detainers are issued for non-citizens who have been arrested or detained for any reason, including criminal charges, civil matters, or potential immigration violations. However, detainers are especially common for non-citizens with criminal convictions. ICE can also issue a detainer for non-citizens who ICE believes may be a danger to the public or a flight risk. In North Dakota, local law enforcement is not obligated to comply with an ICE detainer. However, some law enforcement agencies may choose to comply with detainers in order to assist ICE with the enforcement of immigration laws. It is important to note that any detention pursuant to an ICE detainer is voluntary on the part of the local law enforcement agency, and any decision not to comply with a detainer cannot serve as the basis for criminal or civil liability.
