How do I apply for an EAD?

In Wisconsin, the pathway to applying for an Employment Authorization Document (EAD) (also known as a work permit) for immigrants, is through the federal government. Generally speaking, an individual must be granted a form of immigration status before obtaining an EAD. First, you must submit Form I-765, Application for Employment Authorization, to the United States Citizenship and Immigration Services (USCIS). Along with the application, you must include evidence that demonstrates your eligibility for the document including proof of immigration status, identity documents, passport-style photos, application fees, and evidence of any value or benefit you are requesting such as a work permit, travel permission, or advance parole. The USCIS will review your application and decide whether or not to approve it. Once your application is approved, you will receive an EAD card which is valid for up to one year. You can then use the card to legally work in the United States for any employer. It is important to note that a denied application for an EAD does not necessarily mean deportation. An immigrant may still be able to obtain other forms of immigration status or legal status that does not require an EAD. It is also important to remember that deportation is a separate process from applying for an EAD. If a person’s immigration status is terminated for any reason, it is important for them to consult a qualified immigration attorney to understand their rights and any available options.
